General Terms and Conditions of Sale

B2B (healthcare professionals) and B2C contractual framework applicable to orders placed on fillerdistribution.com.

These General Terms and Conditions of Sale (hereinafter "GTC") govern all commercial transactions concluded between Filler Distribution (hereinafter "the Seller") and any natural or legal person (hereinafter "the Customer") placing an order on the fillerdistribution.com website. Any order implies full, complete, and unreserved acceptance of these GTC.

1. Scope of application

The fillerdistribution.com website markets class IIa and IIb aesthetic medical devices (hyaluronic acid-based fillers, biostimulators, injectable mesotherapy), professional cosmetic products, as well as accessory injectable equipment.

1.1 B2B Sales (healthcare professionals)

The sale of injectable medical devices is strictly reserved for healthcare professionals authorized to use them, in accordance with article L.4161-1 of the Code de la santé publique. As such, the professional Customer certifies, upon creating their account:

  • to be registered with the relevant professional Order (Ordre national des médecins, des chirurgiens-dentistes, des sages-femmes, etc.);
  • to possess a valid RPPS or ADELI number;
  • to be authorized to perform the procedures for which the products are indicated.

Filler Distribution reserves the right to request any supporting document (professional card, certificate of registration, Kbis of the practice/company) and to refuse any order not accompanied by such proof.

1.2 B2C Sales (individuals)

Sales to individuals are limited to non-injectable cosmetic products and equipment not reserved for professionals. Any injectable medical device is excluded from the B2C scope.

2. Restriction of use and Customer responsibility

HA fillers and biostimulators are medical devices intended exclusively for professional use. Self-injection is strictly advised against and engages the full responsibility of the person performing it.

The professional Customer undertakes to comply with:

  • the indications and contraindications appearing in the manufacturer's instructions;
  • the good injection practices taught by learned societies (SOFCEP, SFMA, SF2MM, etc.);
  • the materiovigilance obligations provided for by articles R.5212-12 and following of the Code de la santé publique in the event of an incident.

3. Order and acceptance

The Customer places an order directly online after validating their cart, delivery and billing details, as well as the payment method. The order becomes firm and final after:

  1. express acceptance of these GTC (checkbox),
  2. confirmation of payment by the banking institution or service provider,
  3. sending by Filler Distribution of a confirmation email detailing the order.

Filler Distribution reserves the right to cancel or refuse any order that presents a dispute with a previous payment, a risk of fraud, or an inconsistency in the professional supporting documents provided.

4. Prices

Prices are expressed:

  • in euros HT (excluding taxes) for validated Pro accounts, with the French VAT at 20 % being added at the time of billing, unless the intra-community regime (reverse charge) or export outside the EU applies;
  • in euros TTC (all taxes included) for B2C accounts, French VAT at 20 % included.

Filler Distribution reserves the right to modify its prices at any time; products will be billed based on the rate in effect at the time of order validation, subject to their availability.

5. Payment

The accepted payment methods are:

  • credit card (CB, Visa, Mastercard, American Express) with 3D-Secure authentication via PayPlug;
  • SEPA bank transfer (details are provided on the pro forma invoice);
  • 30-day payment on invoice for Pro accounts after acceptance of the credit limit by the credit department.

In the event of late payment, penalties equal to three times the legal interest rate will be applied by right (art. L.441-10 of the Code de commerce), along with a flat-rate indemnity of 40 euros for recovery costs (décret n° 2012-1115).

6. Delivery

Orders are shipped via EU express within 24 to 48 business hours, through partner carriers Chronopost, DPD, or UPS.

The transfer of risks takes place upon handing over the package to the carrier. Any anomaly (open package, temperatures out of range) must be recorded on the carrier's slip and reported to Filler Distribution within 48 hours (art. L.133-3 of the Code de commerce).

7. Right of withdrawal

In accordance with article L.221-18 of the Code de la consommation, the B2C Customer has a period of 14 days from receipt of the goods to exercise their right of withdrawal, without having to justify any reasons.

However, pursuant to article L.221-28 of the same Code, the right of withdrawal cannot be exercised for:

  • goods unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection (3°);
  • goods made to the consumer's specifications or clearly personalized (4°);
  • goods liable to deteriorate or expire rapidly (4°), which is the case for medical devices once the primary packaging has been opened.

Consequently, HA fillers, biostimulators, and other medical devices cannot be subject to a right of withdrawal once the package is opened or the primary packaging is unsealed.

For eligible products (cosmetics, non-medical accessories), the withdrawal form is available upon request at contact@fillerdistribution.com. Return costs are borne by the Customer, unless the defect is attributable to the Seller.

8. Warranties

8.1 Legal warranty of conformity

The B2C Customer benefits from the legal warranty of conformity provided for in articles L.217-3 and following of the Code de la consommation, for a period of 2 years from the delivery of the goods. This warranty covers conformity defects existing on the date of delivery.

8.2 Warranty against hidden defects

The Customer may also invoke the warranty against hidden defects provided for in articles 1641 and following of the Code civil, within a period of 2 years from the discovery of the defect.

8.3 Manufacturer's commercial warranty

Medical devices also benefit from the warranties specific to each manufacturer (batch authenticity verifiable via QR code, complete cold chain traceability).

9. Complaints & After-Sales Service

Any complaint (non-conformity, breakage, temperature anomaly, product error) must be addressed to contact@fillerdistribution.com within 48 hours of receipt, accompanied by photographs of the package and the temperature slip if applicable. Filler Distribution undertakes to provide a response within 30 days and to offer, depending on the case, a refund, a credit note, or a replacement of the product.

10. Seller's Liability

Filler Distribution acts as a distributor of the referenced medical devices. It cannot be held liable for consequences resulting from use that does not comply with the manufacturer's indications, the instructions, or good medical practices. The manufacturer's liability is exclusively engaged for design, manufacturing, or information defects (art. L.245-5 and following of the Code de la consommation, CE marking in accordance with art. L.5211-3 of the Code de la santé publique).

Filler Distribution can also not be held liable for the non-performance or poor performance of the contract when this is attributable to the Customer, to the unforeseeable and insurmountable act of a third party unrelated to the provision of the services, or to a case of force majeure.

11. Force majeure

Filler Distribution's contractual obligations will be suspended in the event of a case of force majeure within the meaning of article 1218 of the Code civil (natural disaster, war, epidemic, carrier strike, unavailability of a manufacturer, etc.). Filler Distribution will inform the Customer as soon as possible, and their execution will be postponed until the cause disappears.

12. Personal data

The data collected as part of the execution of the order is processed in accordance with our privacy policy and the RGPD UE 2016/679. For any request to exercise rights, contact the DPO at dpo@fillerdistribution.com.

13. Consumer mediation (B2C)

Pursuant to article L.611-1 of the Code de la consommation, the B2C Customer may, in the event of a dispute that could not be resolved amicably, refer the matter free of charge to the following consumer mediator:

The Customer may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

14. Applicable law and jurisdiction

These GTC are governed by French law. Failing an amicable resolution, any dispute relating to their interpretation or execution will fall under the exclusive jurisdiction of the courts within the jurisdiction of Filler Distribution's registered office (Paris) for professional Customers. For consumer Customers, the rules of legal jurisdiction apply.
